Welcome to SmilingShots. These Terms and Conditions outline what you can expect when using our website and booking our photo booth rental services. By using our website or services, you agree to these Terms.

1. Booking & Payment

A deposit is required to secure your event date. The remaining balance is due before the event begins. We accept multiple payment methods including cash, check, credit card, bank transfer, Zelle, and Venmo. Full payment details and amounts will be outlined in your rental agreement.

2. Cancellation & Rescheduling

We understand plans can change. Cancellation and refund terms will be specified in your rental agreement. Events may be rescheduled subject to availability, provided we receive advance notice. Please contact us as early as possible if your plans change so we can work with you.

3. What We Need From You

To ensure a smooth experience, clients are responsible for providing:

• A secure and dry area with enough space for the photo booth setup.
• A table and chair for props and our attendant.
• A standard electrical outlet near the setup location.
• Access to the event space prior to your rental start time for setup.

Specific requirements for your chosen booth type will be detailed in your rental agreement.

4. During Your Event

Every rental includes a professional attendant to operate the booth and assist your guests throughout the event. Setup and tear-down are handled by our team and are not included in your rental time. If you would like to extend your rental beyond the agreed time, overtime may be available subject to our availability.

5. Equipment Care

Our equipment is professionally maintained and insured. Clients are responsible for any damage caused by guests or venue conditions beyond normal wear and tear. We reserve the right to end service early if our staff or equipment are at risk.

6. Your Photos & Videos

All digital images and videos captured during your event will be delivered within 7 business days. At the event, guests can instantly share their photos and videos via email, text, QR code, or AirDrop.

7. Online Gallery

We host your event photos in an online gallery for 60 days following your event. After this period, all photos are permanently removed from our servers. We recommend downloading your photos before the gallery expires.

Galleries are publicly accessible by default. If you would like a pin-protected gallery for added privacy, please request this at least 48 hours before your event. We will provide you with a unique pin code to share with your guests.

8. Photo Usage & Copyright

SmilingShots may use event photos for promotional purposes, including our website, social media, and marketing materials. If you prefer that your photos remain private, simply let us know in writing before your event and we will respect your wishes. The Provider retains copyright to all photos and videos captured during the event.

9. Service Guarantee

We stand behind our service. In the rare event of a technical issue that affects your booth’s operation, we will make every effort to resolve it quickly. If we are unable to, you will receive a pro-rated adjustment for any affected time.

10. Limitation of Liability

SmilingShots is not responsible for interruptions caused by power failures, venue restrictions, internet issues, or other circumstances beyond our control. We are not liable for loss of digital files due to technical malfunctions or third-party platform issues. Our total liability shall not exceed the amount paid for your event.

11. Indemnification

The Client agrees to indemnify and hold harmless SmilingShots, its officers, employees, and agents from any claims, damages, or liabilities arising from the use of the photo booth during the event, including guest behavior and venue conditions.

12. Force Majeure

Neither party shall be liable for failure to perform due to conditions beyond reasonable control, including natural disasters, severe weather, pandemics, government restrictions, or other unforeseen circumstances.

13. Privacy & Guest Data

During your event, guests may voluntarily provide personal information such as phone numbers or email addresses to receive their photos. This information is used solely for delivering event photos and will not be sold, shared with third parties, or used for marketing purposes.

• Guest phone numbers and email addresses collected at the booth are used only to send gallery links and are not retained for marketing.
• By providing a phone number at the event, guests consent to receiving a one-time SMS with their photo gallery link. Standard messaging and data rates may apply.
• Event photos are stored securely and removed from our servers after the 60-day gallery period.
• Guests may request removal of their individual photos at any time by contacting us at info@smilingshots.com.

14. Website Use

By using our website, you agree not to use the site for illegal purposes, attempt to compromise its security, distribute harmful content, or copy our content without permission. Our website may contain links to third-party sites; we are not responsible for their content or privacy practices.

15. Intellectual Property

All content on smilingshots.com, including text, images, logos, and software, is the property of SmilingShots and is protected by copyright law. “SmilingShots” and associated branding are trademarks of SmilingShots.

16. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or services constitutes acceptance of the revised Terms.
